Charge – Proposed License Suspension – Out-of-State DUI
Outcome – I was retained by the parents of a young man who was attending a graduate-level program in the Philippines, with a 9-hour time difference. The client had been found guilty of a DUI in another state. Under the terms of the National Driver Compact, that state advised Maryland of the conviction. Maryland, therefore, posted the conviction on the MVA record and assessed 12 points resulting in a Revocation Notice. We had a remote hearing before the Office of Administrative Hearings and successfully showed the Administrative Law Judge that MVA had failed to prove its case due to a lack of evidence to support the entry of his MVA record. The ALJ dismissed the case with a “No Action.”
Court – Baltimore County
Charge – Hit and Run
Outcome – woman with many past criminal issues and current mental health issues was charged with failure to remain at the scene of an accident aka “Hit and Run.” The case started with a minor contact in a parking lot. The car owner was not present but, a witness confronted my client and had her leave a note on the car’s window. When the owner returned, the witness told her what had happened. The owner tried the phone number but, my client had left the wrong number, which she admitted to the responding police officer. At trial before a Baltimore County District Court judge, we convinced the judge to grant her a PBJ despite the state’s opposition.
Court – Harford County
Charge – Reversed Guilty Plea on 11 Traffic Citations causing a license suspension
Outcome – I was retained by a New Jersey driver who received and paid 11 moving violations from a single traffic stop in Harford County. This resulted in NJ wanting to suspend his driver’s license for too many points. I filed a Motion asking the court to reopen the cases and set them for trial. The court granted the motion and I appeared at the new trial and he was found Not Guilty on ALL charges. In addition, I got a refund for all of the fines that he had paid. This resulted in NJ withdrawing the proposed suspension.
Court – Baltimore County
Charge – Driving While Under the Influence
Outcome – I represented a gentleman who is a resident of Philadelphia in a very sticky set of charges revolving around an alcohol-related accident on I-95 with his two small children in the car. The State was seeking jail time even though this was only his first alcohol event. He was about to begin a new job with the City of Philadelphia and was very active with his family and children. He had a very colored past that, had it come up in court, would have no doubt not been helpful. After discussions with the State’s Attorney, and with a good judge, we persuaded the judge to reject the state’s recommendation and grant Probation Before Judgment.
Court – MVA Hearing
Charge – Refusal of an Alcohol Breath Test
Outcome – We represented a person in his first-ever alcohol-related charges and an allegation that he refused to take a chemical breath test. He was facing a potential 270-day suspension of his driver’s license. We faced an uphill fight but, we successfully persuaded the Administrative Law Judge (“ALJ”) that MVA failed to present evidence that was legally sufficient to prove its case. The ALJ granted my request for a “No Action” dismissing the case.
Court – Baltimore County
Charge – CDL High-Speed Case
Outcome – My client, a CDL holder, was charged with a very high-speed violation in addition to charges of Reckless Driving and Negligent Driving. He was understandably very anxious about how this would affect his ability to support his family and earn a living as a commercial driver. I discussed the case with the charging officer and persuaded him to amend the speed charge and dismiss the reckless and negligent charges. This resulted in keeping his driving record clean and dismissing the threat to his CDL.
Court – Carroll County District Court
Charge – Fleeing and Eluding
Outcome – We represented a young man we have represented several times. He was charged with serious violations including Fleeing and Eluding a police officer. After several conversations with the State’s Attorney, and various last-minute hiccups, we succeeded in having ALL charges placed on the Stet docket assuming he fulfills several reasonable conditions. This is essentially an indefinite postponement. The main goal was to keep any conviction or PBJ off of his record because he still has a (suspended) provisional license, MVA would have suspended him again. This was a huge accomplishment for our client.
